LIABILITY WAIVER, RELEASE & ASSUMPTION OF RISK — Wing Foiling Instruction

In consideration of being permitted to participate, I agree as follows:

1. ASSUMPTION OF INHERENT RISKS. I understand wing foiling takes place in open water and carries inherent risks that cannot be eliminated, including drowning and submersion; changing wind, surf, tide, current and weather; collision with the board, hydrofoil, mast, wing, persons, watercraft, marine life or submerged objects; lacerations from the foil; equipment failure; sunstroke, hypothermia and exhaustion; and the conduct of others. I knowingly assume all such risks, known and unknown.

2. MEDICAL FITNESS. I represent that I am in good health, a competent swimmer, and have no condition impairing safe participation. I authorize emergency medical treatment at my expense.

3. RELEASE OF LIABILITY. I release and discharge Edo Tanas, T2B and their agents from all claims for injury, death or property loss arising from my participation, including claims based on ordinary negligence, to the fullest extent permitted by law.

4. INDEMNIFICATION. I agree to hold harmless and indemnify the released parties from claims brought by me or on my behalf, including attorneys' fees.

5. EQUIPMENT & INSTRUCTIONS. I will use equipment as directed, wear required safety gear, and follow all safety instructions.

6. WEATHER & CONDITIONS. Sessions may be delayed, shortened, rescheduled or cancelled at the instructor's discretion for safety; refunds follow the booking policy.

7. MEDIA RELEASE. I permit use of photos/video of my participation for instructional and promotional purposes without compensation.

8. INSURANCE. I am responsible for my own medical coverage.

9. MINOR. If under 18, my parent/guardian signs and accepts these terms on my behalf.

10. GOVERNING LAW. Governed by the laws of Hawaii; if any provision is unenforceable the rest remains in effect.

11. ACKNOWLEDGMENT. I have read this waiver, understand I am giving up legal rights, and sign freely and electronically.
